The Competition Board may impose high fines on the parties of cartels and other practices restrictive of competition, which cause serious harm to the public, within the framework of the relevant articles of the Act no 4054. However, if the undertakings or their employees who are parties to the agreement actively cooperate with the Authority in order to reveal the violation of the Act no 4054, they may not be imposed fines or fines may be reduced. Procedures and principles of non-imposition or reduction of fines for those who actively cooperate with the Authority in order to detect and investigate cartels are stated in the Regulation on Active Cooperation for Detecting Cartels (Leniency Regulation). The implementation of the regulation is explained in the Guidelines on the Explanation of the Regulation on Active Cooperation for Detecting Cartels. For example, pursuant to the Competition Board decision dated 03.05.2012 and no 12-24/711-199, one of the undertakings under investigation applied for benefitting from the Leniency Regulation and performed all the required liabilities; thus, the fine imposed on this undertaking was reduced by 1/3, and the undertaking was imposed a fine of 545,735 TL instead of 818,603 TL. A 50% reduction was applied on the fine imposed to the Director General of the relevant undertaking within the scope of the same decision.
The Cartel and On-Site Inspection Support Unit has been assigned by the Competition Board to implement the Regulation, which regulates the procedures and principles for non-imposition or reduction of fines to be imposed on those who actively cooperate with the Authority in order to detect and investigate cartels.
