Investigation Initiated on Booking.com B.V. and Bookingdotcom Destek Hizmetleri Limited Şirketi (29.7.2015)

The Competition Board took its decision concerning the preliminary inquiry which was launched in response to the complaint claiming that the "best price guarantee" promised by Booking.com B.V. and its Turkish office Bookingdotcom Destek Hizmetleri Limited Şirketi to their customers within the framework of the booking services they provide constituted a violation under articles 4 and 6 of the Act no 4054.

The Competition Board, after discussing the information, documents and observations gathered during the preliminary inquiry on its meeting of 09.07.2015, deemed the findings significant and sufficient, and took the decision numbered 15-28/432-M to initiate an investigation concerning

- Booking.com B.V., and
- Bookingdotcom Destek Hizmetleri Limited Şirketi.

As is known, article 4 of the Act no 4054 prohibits anti-competitive agreements and concerted practices between undertakings, while article 6 prohibits abuses of dominant position. The investigation was initiated in order to determine whether the undertakings in question violated articles 4 and 6 of the Act no 4054 through various practices, including their "best price guarantee".

These declarations, which are made within the framework of informing the public on Competition Board decisions, cannot be interpreted to mean the undertakings or associations of undertakings under investigation have violated the Act no 4054 and that they have faced or will face sanctions under the Act.
