The Competition Board reevaluated the claim that EAE Elektrik Asansör Endüstrisi İnşaat Sanayi ve Ticaret A.Ş. made misleading and discrediting statements about the complainant’s products to customers and made the customers buy its products upon the decision of the Ankara 7th Administrative Court.

Previously, as a result of the preliminary inquiry about the claims in question, the Board took the decision dated 12.11.2019 and numbered 19-39/603-257 that it was not necessary to initiate an investigation regarding the claims in question according to article 41 of the Act. However, the Board decision in question was annulled partially by the decision of Ankara 7th Administrative Court dated 03.03.2022 and numbered 2020/1318 E. and 2022/488 K.

Having discussed the information and documents in the file in its meeting dated 28.04.2022, the Board took the decision no 22-20/316-M that an investigation shall be initiated concerning EAE Elektrik Asansör Endüstrisi İnşaat Sanayi ve Ticaret A.Ş. in order to fulfill the requirements of the Court decision.
