Investigation which was conducted about Certain Undertakings Due To Gentlemen's Agreements in the Labor Market Concluded (1.03.2024) (4.3.2024)

The investigation which was conducted to determine whether article 4 of the Act no 4054 on the Protection of Competition was violated by means of gentlemen’s agreements in the labor market has been concluded.

As a result of the investigation, it has been decided that

violated article 4 of the Act no 4054 on the Protection of Competition by participating in anticompetitive agreements and the actions in question cannot benefit from individual exemption under article 5 of the Act no 4054 on the Protection of Competition; therefore, the aforementioned undertakings shall be imposed administrative fines, and

could not be found to have violated article 4 of the Act no 4054 on the Protection of Competition within the framework of the claims that are the subject of the file; therefore, it is not necessary to impose administrative fines according to Article 16(3) of the Act no 4054 on the Protection of Competition, with the decision subject to review before Ankara Administrative Courts within 60 days as of the notification of the reasoned decision.
