The investigation initiated in order to determine whether the Turkish Underwater Sports Federation abused its dominant position under article 6 of the Act no 4054 was concluded.
The investigation was opened as a result of the preliminary inquiry, which was conducted in response to the application claiming that Turkish Underwater Sports Federation restricted competition by placing divers with certificates from systems other than the World Underwater Federation (CMAS) under an obligation to get additional Divers ID certificates and pay additional fees and thereby obstructing the operations of other training systems.
During the investigation phase, it was examined whether Turkish Underwater Sports Federation abused its dominant position via its various practices aimed at training systems other than CMAS.
As a result of the Competition Board's discussion on the file at its meeting of 27.12.2012, it was decided, by majority vote, that Turkish Underwater Sports Federation's various practices aimed at training systems other than CMAS did not carry the characteristics of abuse as specified in article 6 of the Act no 4054, and that it was not necessary to impose administrative fines on Turkish Underwater Sports Federation under article 16 of the same Act.
