The Competition Board concluded the preliminary inquiry into the claim that articles 4 and 6 of the Act no 4054 on the Protection of Competition were violated by means of practices leading to exclusivity in terms of the provision of charging services to electric vehicles on İzmir-İstanbul O-5 highway.
After discussing the information and documents acquired and observations made in the preliminary inquiry in its meeting on 04.07.2024, the Board considered the findings significant and sufficient and took the decision no 24-28/679-M to open an investigation
i) on Otoyol İşletme ve Bakım AŞ (OİB) and ZES Dijital Ticaret AŞ (ZES) about the violation of articles 4 and 6 of the Act no 4054 due to exclusivity practices in the market for charging network operation on O-5 highway,
ii) in addition, on OİB about the violation of article 6 of the Act no 4054 through discrimination between undertakings in the market for charging network operation.
OİB is the sole operator of the service facilities called Oksijen, located on İzmir-İstanbul O-5 highway, which connects Kocaeli and İzmir through Osmangazi Bridge.
ZES is operating in the field of installing and operating electric vehicle charging stations throughout Türkiye.
