Investigation Launched on Microsoft Bilgisayar Yazılım Hizmetleri Ltd. Şti. (31.5.2017)

Competition Board re-evaluated the complaint claiming that the Act no 4054 was violated by the “3+ Project,” aimed at cyber cafés, following a decision by the 13th Chamber of the Council of State.

Previously, the preliminary inquiry conducted due to the relevant complaint had examined the practice in question and on 07.11.2011, the decision no 11-60/1555-550 was taken stating that the complaint should be dismissed and that initiating an investigation was not necessary. However, the aforementioned Board decision was annulled with the 13th Chamber of the Council of State's decision dated 25.10.2016 and numbered 2012/1000 E., 2016/3413 K.

After discussing the information and documents included in the file in its meeting of 20.04.2017, and in light of the issues reaised in the relevant court decision, the Board took the decision no 17-13/171-M to initiate an investigation in accordance with article 41 of the Act no 4054 on

in order to determine whether article 6 of the same Act was violated.

As known, article 6 of the Act no 4054 prohibits abuses of dominant position.
