With its decision dated 21.05.2024 and numbered 24-23/520-M, the Competition Board launched an investigation on İtameks Dış Ticaret ve Pazarlama Anonim Şirketi (İTAMEKS) and Özelcan Babymall Mağazacılık Dağıtım Sanayi ve Ticaret Anonim Şirketi (ÖZELCAN), on the suspicion that they violated Article 4 of the Act no 4054 on the Protection of Competition (Act no 4054) through anti-competitive practices aimed at their dealers.
İTAMEKS is active in Türkiye as the sole distributor of 4MOMS brand baby products, while ÖZELCAN is a dealer of İTAMEKS which is engaged in the wholesale and retail sale of baby products from various brands through the e-commerce, wholesale and franchise channels.
The investigation will be conducted to determine if İTAMEKS and ÖZELCAN violated Article 4 of the Act no 4054, the former by fixing resale prices of its dealers and introducing various restrictions on competition for sales channels, and the latter by fixing resale prices of its franchise stores, restricting passive sales and introducing non-compete obligation under franchising agreements..
