The Competition Authority came to a decision concerning the preliminary inquiry which was started in response to the request to determine whether the contract between the Turkish Football Federation (TFF) and Krea İçerik Hizmetleri ve Prodüksiyon A.Ş. (Digiturk) related to the acquisition of the Super League broadcast rights was extended for two years and to initiate proceedings in case these claims were true.
After examining the information, evidence and the findings gathered in the preliminary inquiry in its meeting of 06.12.2012, the Board concluded that the findings were significant and sufficient, and decided to open an investigation under article 41 of the Act no 4054 on the Protection of Competition concerning the Turkish Football Federation and Krea İçerik Hizmetleri ve Prodüksiyon A.Ş.
Article 4 of the Act no 4054 prohibits all anti-competitive agreements and concerted practices. As a result of the assessments made, it was found that the agreement signed on 21.05.2012 between TFF and Digiturk related to the transfer of broadcast rights within the framework of the Package A Broadcast Rights Agreement to include the 2015-2016 and 2016-2017 football seasons regulated a shorter period for the transfer of rights in comparison to the previous agreement which was denied exemption with the Competition Board decision dated 30.04.2012 and numbered 12-23/659-181; however, it was decided that the agreement should be subjected to an individual exemption assessment to determine whether it fulfilled the relevant requirements to be exempt from the application of article 4 of the Act and that an investigation should be initiated in order to establish whether article 4 of the Act no 4054 was violated by the parties.
