As a result of the annulment of the decision no dated 25.02.2009 and numbered 09-08/155-48 by the 13th Chamber of the Council of State, Competition Board re-evaluated the complaint application concerning Renault Trucks Türkiye Ticaret A.Ş.
The application in question claimed that Renault Trucks Türkiye Ticaret A.Ş. refused requests to become authorized services for reasons unrelated with the nature of the service that is the subject of the agreement, restricted private services' access to technical information, equipment and training, and discriminated between authorized services and private ones.
After examining the information, evidence and the findings gathered in the file in its meeting of 21.08.2013, the Board decided to open an investigation under article 41 of the Act no 4054 on the Protection of Competition concerning Renault Trucks Türkiye Ticaret A.Ş.
Article 4 of the Act no 4054 prohibits all anti-competitive agreements and concerted practices between undertakings. The investigation was initiated in order to determine whether Renault Trucks Türkiye Ticaret A.Ş. violated article 4 of the Act no 4054 by failing to ensure that "Authorized Service Standards" were prepared in compliance with the Block Exemption Communiqué concerning Vertical Agreements and Concerted Practices in the Motor Vehicles Sector, no 2005/4 and by discriminating between authorized and private services.
