The complaint application which included the claim that Microsoft Bilgisayar Yazılım Hizmetleri Ltd. Şti., Microsoft Corporation and Microsoft Ireland Operations Limited complicated the operations of Gelecek Bilişim ve İletişim A.Ş. with the pressure placed on the distribution channels and the discount systems was re-evaluated.

After discussing the information and documents in the file in its meeting of 28.08.2012, the Board decided to initiate an investigation concerning
- Microsoft Bilgisayar Yazılım Hizmetleri Ltd. Şti.,
- Microsoft Corporation, and
- Microsoft Ireland Operations Limited
under article 40 of the Act no 4054 on the Protection of Competition. 

As known, article 6 of the Act no 4054 prohibits abuses of dominant position. The investigation was initiated in order to determine whether there was an infringement of article 6 of the Act no 4054,  following the annulment, by the 13th Chamber of the Council of State, of the Competition Board decision dated 27.05.2008 and numbered 08-35/465-165 which was taken as a result of the preliminary inquiry conducted in response to the aforementioned complaint.

*Investigation decisions taken by the Competition Board are announced to the public following the notification of the decision to the undertakings or associations of undertakings under investigation. These declarations, which are made within the framework of informing the public on Competition Board decisions, can not be interpreted to mean the undertakings or associations of undertakings under investigation have violated the Act no 4054 and that they have faced or will face sanctions under the Act.
