As a result of the 13th Chamber of the Council of State's annulment of the Competition Board decision dated 04.07.2007 and numbered 07-56/669-232 on the subject, Competition Board re-evaluated the complaint application which included the claim that 3M Sanayi ve Ticaret A.Ş. violated article 4 of the Act no 4054 on the Protection of Competition by enforcing region and customer restrictions on its dealers, by fixing final sales prices for its dealers and by engaging in discriminatory practices among its dealers.

After the examination of the information and documents included in the file in its meeting of 29.05.2013, the Board decided to initiate an examination concerning 3M Sanayi ve Ticaret A.Ş.

As is known, article 4 of the Act no 4054 prohibits anti-competitive agreements and concerted practices between undertakings, and the investigation was initiated in order to determine whether the Act was violated in this respect.

*Investigation decisions taken by the Competition Board are announced to the public following the notification of the decision to the undertakings or associations of undertakings under investigation. These declarations, which are made within the framework of informing the public on Competition Board decisions, cannot be interpreted to mean the undertakings or associations of undertakings under investigation have violated the Act no 4054 and that they have faced or will face sanctions under the Act.
