The investigation conducted in order to determine whether Doğan TV Digital Platform İşletmeciliği A.Ş., Mozaik İletişim Hizmetleri A.Ş. and Krea İçerik Hizmetleri ve Prodüksiyon A.Ş. violated articles 4 and/or 6 of the Act no 4054 by rejecting Sinema Televizyon Yayıncılık ve Prodüksiyon A.Ş.’s request to access the satellite platform was concluded.
The investigation was launched in response to the 17th Administrative Court of Ankara’s decision dated 25.02.2015 and numbered 2014/1365 E., 2015/255 K, annulling the Board decision of 20.05.2014, numbered 14-18/345-152, which ruled that the complaint should be rejected and an investigation should not be initiated.
The investigation launched with the Competition Board decision dated 24.04.2015 and numbered 15-22/269-M took the issues pointed out in the aforementioned court decision into consideration and examined whether Doğan TV Digital Platform İşletmeciliği A.Ş., Mozaik İletişim Hizmetleri A.Ş. and Krea İçerik Hizmetleri ve Prodüksiyon A.Ş. Violated articles 4 and/or 6 of the Act no 4054.
As a result of the discussion of the file by the Competition Board on 18.05.2016, it was decided that Doğan TV Digital Platform İşletmeciliği A.Ş., Mozaik İletişim Hizmetleri A.Ş. and Krea İçerik Hizmetleri ve Prodüksiyon A.Ş. did not violate articles 4 and/or 6 of the Act no 4054 and therefore imposing administrative fines on the undertakings concerned under article 16 of the same ct was not necessary.
