The investigation that was launched on 11.05.2023 with the Competition Board decision numbered 23-21/411-M concerning the claim that Canon Eurasia Görüntüleme ve Ofis Sistemleri AŞ (CANON) violated Article 4 of the Act no 4054 on the Protection of Competition (Act no 4054) has been concluded.
CANON operates in the field of manufacturing and sales of optical products comprised of printing, copying, display and photo-video products as well as digital SLR cameras, digital video cameras, mirrorless compact system cameras and interchangeable lenses, and it is active in Türkiye with relation to the distribution of the aforementioned products. In that framework, the distribution of the relevant products are carried out through distributors. Distributors themselves resell Canon brand products to various wholesalers and retailers, which include resellers such as technology retail stores, dealers in the traditional channel, online marketplaces and dealers active in online marketplaces.
During the investigation process it was examined whether CANON maintained resale prices by intervening in the sale prices of sellers or dealers that resold the Canon brand products it supplied, despite the requirement to set these prices independently. The hearing for the investigation conducted to determine whether CANON violated Article 4 of the Act no 4054 by fixing the prices of its various resellers was held on 04.06.2024. Following the hearing, the Competition Board took the decision dated 12.06.2024 and numbered 24-26/640-265, ruling that CANON violated Article 4 of the Act no 4054 and imposing an administrative fine of 38,300,958.83 TL on CANON.
