Investigation Conducted about Undertakings Operating in Power Transformer Sector Concluded (21.3.2025)

The investigation, which is conducted according to the Competition Board (Board) decisions dated 13.07.2023 and numbered 23-31/596-M, dated 28.09.2023 and numbered 23-46/875-M, and dated 09.05.2024 and numbered 24-22/505-M to determine whether certain undertakings operating in the sector for power and distribution transformer as well as switchgear and concrete kiosk, which are breakdown of electricity transmission and distribution equipment, violated the Act no 4054 on the Protection of Competition has been concluded.

In the meeting of the Board dated 13.03.2025, the decision numbered 25-10/246-126 to impose administrative fines to some of the undertakings party to the investigation was taken on the grounds that the undertakings in question colluded for sales and coordinated prices.

In the investigation, SEM Transformatör AŞ (SEM) applied for settlement and admitted that it violated article 4 of the Act no 4054. Therefore, since the investigation was terminated with settlement, the Board made 25% reduction in the fine it decided and took the decision numbered 24-12/216-89 that SEM shall be imposed 42.379.948,55-TL administrative fines.

As a result of the investigation, it has been decided that

  • The economic unity composed of Astor Enerji AŞ and EFG Elektrik Enerji AŞ shall be imposed 339.807.744,37–TL,
  • Balıkesir Elektromanyetik Sanayi Tesisleri AŞ shall be imposed 69.033.435,02–TL,
  • Beta Enerji ve Teknoloji AŞ shall be imposed 32.315.343,47-TL,
  • Ekos Teknoloji ve Ticaret AŞ shall be imposed 12.736.611,33- TL,
  • Eltaş Transformatör Sanayi ve Ticaret AŞ shall be imposed 13.519.367,79-TL,
  • Eva Elektromekanik Sanayi ve Ticaret AŞ shall be imposed 7.231.510,29-TL,
  • Monokon Elektrik Sanayi ve Ticaret AŞ shall be imposed 898.433,90-TL and
  • Ulusoy Elektrik İmalat Taahhüt ve Ticaret AŞ shall be imposed 19.272.557,17–TL

administrative fines, in addition, concerning the economic unity composed of

  • Armtek Elektrik Sanayi ve Ticaret AŞ,
  • ATS Elektrik Pano Sanayi Ticaret Ltd. Şti. and
  • Girişim Elektrik Sanayi Taahhüt ve Ticaret AŞ ve Europower Enerji ve Otomasyon Teknolojileri Sanayi Ticaret AŞ,

it is necessary to impose administrative fines according to article 16(3) of the Act no 4054, however, since administrative fines were imposed according to the Board decision dated 13.03.2025 and numbered 25-10/235-120, within the framework of “ne bis in idem” general legal principle, it is not necessary to impose new administrative fines to the said undertakings under the scope of this investigation.

Moreover, it has been decided that concerning the following parties to the investigation

  • Kontrolmatik Teknoloji Enerji ve Mühendislik AŞ ve

it is not necessary to impose administrative fines.

Power transformers and distribution transformers produced by parties to the investigation are used in transforming electric voltage whereas switchgears and concrete kiosks are used for ensuring security during the distribution of power.
