Investigation Concerning Two Undertakings Operating in the Steel Straps Market Concluded (27.12.2012)

The investigation conducted concerning two undertakings operating in the steel straps market in order to determine whether they violated  article 4 of the Act no 4054 was concluded.
The investigation was launched as a result of the preliminary inquiry, which was initiated in response to the information received claiming that MPS Metal Plastik Sanayi Çember ve Paketleme Sistemleri İmalat ve Tic. A.Ş. and BEKAP Metal İnş. San. ve Ticaret A.Ş. were in collusion concerning sales prices to be implemented for steel straps. 

During the investigation stage, it was examined whethere there was an agreement between the aforementioned undertakings concerning the sales prices to be implemented in steel straps and other terms of sales.
As a result of the the Competition Board's discussion on the file at its meeting of 30.10.2012, 
 
      - MPS Metal Plastik Sanayi Çember ve Paketleme Sistemleri İmalat ve Tic. A.Ş.
      - Bekap Metal İnşaat San. ve Tic. A.Ş.’ye, 

 were imposed administrative fines for violating article 4 of the Act no 4054 on the Protection of Competition, by acting in collusion in steel strap purchase tenders initiated by some customers which make procurements via tenders; by jointly setting prices and/or terms of sales to be implemented for other customers; and by holding meeting and exchanging information to that end. 

Since one of the parties to the violation, MPS Metal Plastik Sanayi Çember ve Paketleme Sistemleri İmalat ve Tic. A.Ş., admitted the existence of the violation and entered into active cooperation in accordance with the "Regulation on Active Cooperation for Detecting Cartels," the administrative fine imposed on this undertaking was discounted by half.

On the other hand, as a result of the assessments made concerning natural persons, they were found not to have had a decisive influence on the violation in question and it was decided, UNANIMOUSLY, that it was not necessary to impose administrative fines on these natural persons.
