Investigation concerning Tekhnelogos Yazılım Müh. Müş. ve Bilişim Hizm. San. ve Tic. Ltd. Şti. and Üç Elma Sigorta Aracılık Hizmetleri Ltd. Şti. Concluded (26.9.2014)

Competition Authority concluded the investigation which was initiated in order to determine whether article 6 of the Act no 4054 was violated by Tekhnelogos Yazılım Müh. Müş. ve Bilişim Hizm. San. ve Tic. Ltd. Şti. by abusing the advantage it held at the level of online submission of natural gas domestic installation projects to the benefit of its subsidiary Üç Elma Sigorta Aracılık Hizmetleri Ltd. Şti. and by obstructing the inclusion of policies drawn by alternative insurance companies in this process.

The investigation was launched as a result of the preliminary inquiry which was launched in response to the application claiming that Tekhnelogos Yazılım Müh. Müş. ve Bilişim Hizm. San. ve Tic. Ltd. Şti., directly or indirectly, complicated the hand-delivery of natural gas domestic installation projects and obligated the use of the online submission/approval system (DİPOS Plus), and that in projects submitted via DİPOS Plus it indirectly forced companies to only make transactions through its own insurance agency Üç Elma Sigorta Aracılık Hizmetleri Ltd. Şti. During the investigation phase, it was examined whether the undertaking under investigation held dominant position and whether it obstructed the operations of competing insurance companies during the implentation of the agreement it concluded with Başkentgaz concerning the online submission of natural gas projects.

As a result of the discussion of the file by the Competition Board on 16.09.2014,

Administrative fines were imposed on Tekhnelogos Yazılım Müh. Müş. ve Bilişim Hizm. San. ve Tic. Ltd. Şti. and on Üç Elma Sigorta Aracılık Hizmetleri Ltd. Şti., which has the same partnership structure with the former undertaking, on the grounds that they violated article 6 of the Act no 4054 by obstructing the operations of their competitors.
