Investigation concerning MDF and Particle Board Industrialists’ Association and Seven Undertakings active in Particle Board and MDF Market (19.3.2019)

Following Ankara 16th Administrative Court’s decision, the Competition Board reevaluated the claims that seven undertakings active in particle board and MDF market and MDF and Particle Board Industrialists’ Association violated articles 4 and 6 of the Act no. 4054 by means of sharing information that decreased the uncertainty in the market, discrimination, tying and refusal to supply.

Previously, as a result of the preliminary inquiry concerning the claims in question, the Competition Board took the decision dated 13.10.2016 and numbered 16-33/571-248 to reject the complaint and not to initiate an investigation according to article 41 of the Act. However, the Board decision in question was annulled by Ankara 16th Administrative Court’s decision dated 25.10.2018 and numbered 2017/374 E. and 2017/2244 K. 

Accordingly, in its meeting of 07.02.2019, in order to ensure that requirements of 16th Ankara Administrative Court’s annulment decision are fulfilled, the Board took the decision no. 19-06/48-M to initiate an investigation about the following undertakings to determine whether the said undertakings violated articles 4 and 6 of the Act no. and to combine this investigation with the investigation initiated according to the decision dated 01.11.2018 and numbered 18-41/654-M.

     - Yıldız Sunta Orman Ürünleri Sanayi Tesisleri İth. İhr. ve Tic. A.Ş. 

*Investigation decisions taken by the Competition Board are announced to the public following the notification of the decision to the undertakings or associations of undertakings under investigation. Those announcements, which are made within the framework of informing the public about the decisions of the Competition Board, cannot be interpreted to mean that the undertakings or associations of undertakings under investigation have violated the Act no 4054, or they are or will be subject to penal sanctions under the Act.
