The preliminary inquiry about the claim that Kayseri Chamber of Bakers and Flour Sellers intervened in the sale price of bread determined by the bakeries operating in Kayseri and accordingly forced undertakings to make sales at a certain level of price was concluded by the Competition Board.
After discussing the information, documents and findings acquired in the preliminary inquiry in its meeting of 05.03.2015, the Board considered that the findings were significant and sufficient, and took the decision numbered 15-10/138-M that an investigation shall be initiated on Kayseri Chamber of Bakers and Flour Sellers and Turkish Federation of Bread Producers.
As it is known, article 4 of the act no 4054 prohibits agreements and concerted practices between undertakings as well as decisions and practices of associations of undertakings that restrict competition. The investigation was initiated in order to establish whether the said Chamber and Federation violated article 4 of the Act no 4054 by intervening in the freedom of bread producers to determine their own prices.
*Investigation decisions taken by the Competition Board are announced to the public following the notification of the decision to the undertakings or associations of undertakings under investigation. Those announcements, which are made within the framework of informing the public about the decisions of the Competition Board, cannot be interpreted to mean that the undertakings or associations of undertakings about which the investigation is opened have violated the Act no 4054, or they are or will be subject to penal sanctions under the Act.
