Following the decision of the 13th Chamber of the Council of State, the Competition Board re-evaluated the application about the claims that chicken meat and eggs of the Lezita brand belonging to Abalıoğlu Yem Soya ve Tekstil A.Ş. were provided to the applicant via a contract including exclusive dealership condition and that the Act No. 4054 was infringed due to the annulment of the contract because the applicant sold products of other brands.
The preliminary inquiry made previously due to the said complaint examined the practices in question and the decision numbered 11-43/940-304 was taken on 14.07.2011 to reject the complaint and not to initiate an investigation. However, the Board decision in question was annulled by the decision of the 13th Chamber of Council of State dated 27.12.2017 and numbered E: 2011/3511, K: 2017/4404.
After discussing the information and documents in the file in its meeting of 18.04.2018 and considering the issues laid down in the relevant court decision, the Board took the decision no.18-11/205-M to initiate an investigation about Abalıoğlu Yem Soya ve Tekstil A.Ş. to determine whether the said undertaking violated article 4 of the Act No. 4054 according to article 41 of the same act.
*Investigation decisions taken by the Competition Board are announced to the public following the notification of the decision to the undertakings or associations of undertakings under investigation. Those announcements, which are made within the framework of informing the public about the decisions of the Competition Board, cannot be interpreted to mean that the undertakings or associations of undertakings about which the investigation is opened have violated the Act no 4054, or they are or will be subject to penal sanctions under the Act.
