The final examination concerning the acquisition of the entirety of the shares of Beta Marina Liman ve Çekek İşletmesi A.Ş. and Pendik Turizm Marina Yat ve Çekek İşletmesi A.Ş. by Setur Servis Turistik A.Ş., conducted with the Competition Board decision dated 07.08.2014 and numbered 14-26/522-M, was concluded.

During the final examination process, the Board examined whether the transaction concerned would lead to the relevant undertaking acquiring dominant position, thereby significantly lessening competition in the market, in violation of article 7 of the Act no 4054 on the Protection of Competition.

As a result of the discussion of the file by the Competition Board, on 09.07.2015 the Board took the decision no 15-29/421-118 by majority, which provides that the acquisition of the entirety of the shares of Beta Marina Liman ve Çekek İşletmesi A.Ş. and Pendik Turizm Marina Yat ve Çekek İşletmesi A.Ş. by Setur Servis Turistik A.Ş.was subject to authorization under the Communiqué Concerning the Mergers and Acquisitions Calling for the Authorization of the Competition Board, no 2010/4, and that the transaction in question should be rejected under article 7 of the Act no 4054 since it would lead to Koç Holding A.Ş. to acquire dominant position in the relevant market defined in relation to the İstanbul City Port Marina and therefore would significantly lessen competition in the market.
