The investigation launched with the Competition Board decision dated 18.04.2024 and numbered 24-19/407-M to determine if Viking Kağıt ve Selüloz Sanayi ve Ticaret AŞ violated Article 4 of the Act no 4054 on the Protection of Competition by fixing the resale prices of its buyers was concluded.
The settlement text submitted by the Viking Kağıt ve Selüloz Sanayi ve Ticaret AŞ during the investigation process was accepted with the Competition Board decision dated 07.11.2024 and numbered 24-45/1059-451, and the investigation was terminated with a settlement.
In that framework, Viking Kağıt ve Selüloz Sanayi ve Ticaret AŞ acknowledged that it engaged in practices aimed at maintaining the resale prices of its buyers and thereby violated Article 4 of the Act no 4054 on the Protection of Competition. Since the investigation was concluded via the settlement process, a discount of 15% was applied to the administrative fines, and Viking Kağıt ve Selüloz Sanayi ve Ticaret AŞ was imposed an administrative fine of 9,073,292.11 TL.
Viking Kâğıt is active in the cleaning products market in the production and sales of toilet paper, paper towels, paper napkins, wet wipes, wet towels, cologne, facial tissues and tissue paper with the Lily, Terra, Senso, Pufla, Select, Select Nature and Green4u brands.
As known, under the settlement procedure introduced into the competition law legislation with the amendment made into Article 43.5 of the Act no 4054 on the Protection of Competition by the Act no dated 16.06.2020 and numbered 7246, the Board may, on the request of the parties concerned or on its own initiative, launch the settlement procedure and terminate the investigation after taking into consideration the procedural benefits that may arise from a rapid conclusion of the investigation process and the varying opinions concerning the existence or scope of the infringement.
