The application concerning the acquisition of single control over Monsanto Company by Bayer Aktiengesellschaft was taken under final examination within the decision of the Competition Board dated 15.05.2017 and numbered 17-16/226-M.

As known, article 7 of the Act no 4054 on the Protection of Competition tasks the Competition Board with the duty control merger and/or acquisition transactions which result in a significant decrease in Competition within markets. Within the framework of article 10 of the Act, the Board may take those transactions which require a more in-depth examination in terms of their effect on the competitive structure under final examination.

In accordance with article 10, a merger-acquisition transaction notified to the Board is suspended until the final decision is taken and may not be implemented. However taking the transaction under final examination does not necessarily mean that the transaction is not allowable by nature.
