The investigation launched with the Competition Board decision dated 24.01.2024 and numbered 24-06/93-M in order to determine whether ABC Deterjan Sanayi ve Ticaret AŞ violated Article 4 of the Act no 4054 on the Protection of Competition by fixing resale prices of its buyers is concluded.

The Competition Board decided to terminate the investigation after accepting the settlement text submitted by the parties with its decision dated 21.03.2024 and numbered 24-14/290-119. Within this framework, ABC Deterjan Sanayi ve Ticaret AŞ admitted that it fixed the resale prices of its buyers and thus violated Article 4 of the Act no 4054 on the Protection of Competition. Since the investigation was concluded with a settlement, a discount of 25% is applied to the administrative fines concerned, and ABC Deterjan Sanayi ve Ticaret AŞ is imposed an administrative fine of 4,635,094.32 TL.

As known, within the context of the settlement practice introduced into the competition law legislation with the amendment of Article 43.5 of the Act no 4054 on the Protection of Competition, made by the Act no 7246 dated 16.06.2020, the Board may initiate a settlement procedure and terminate the investigation on the request of the parties concerned or on its own initiative, taking into account the procedural benefits that may arise from a rapid conclusion of the investigation process as well as the differences of opinion concerning the presence or scope of the infringement.
